It is really awful. I'm deeply concerned for the girl's mom. I don't think anyone would want to be in her shoes. Such a nonsense accident.

Where was the teacher, most likely trying to teach an overcrowded classroom. As for the kids involved so sad, classroom prank gone wrong I would say it was a accident , fatal  but not intentional or premeditated murder.all i can say is there for the grace of god go I.

Yes, the worst the kid could get in most states of the US would be involuntary manslaughter, and that would mean that an act not intended to cause death had caused the death of that child. A kind of maximum of lack of responsibility.

If, in fact, the seizure was merely coincidental in time, then the paperclip hitting her skull would not be the cause of death. I think that is the case.

I honestly don't believe that the girl responsible for the prank should be charged for murder. That is simply ridiculous to even think of. The fact of the matter is, even a grown person wouldn't think of a paperclip hitting another persons head as fatal, even at terminal velocity. If a paperclip caused a her death, then that poor girl didn't have a chance in the world at survival of more normal things like falling off the monkey bars or even a car accident.

It's just a terrible situation in the midst of a seemingly normal classroom activity. Perhaps the seizure was caused by the victim's emotional reaction to being "picked on" and the paperclip was the icing on the cake that caused a flare up.
