On October 14, the U.S. Supreme Court also refused to hold a hearing on the case of Troy Davis. That means that now, no court of law will ever hold a hearing on evidence that has raised serious doubts about his guilt. In July 2007, you stated that the Board "will not allow an execution to proceed in this State unless and until its members are convinced that there is no doubt as to the guilt of the accused." While I was deeply disappointed when you denied clemency to Troy Anthony Davis on September 12 of this year, I understand you can reconsider this decision at any time. Please do so.
Doubts of Troy Davis’ guilt will always remain. In their dissent from the March 2008 ruling denying Troy Davis a new trial or hearing, three members of the Georgia Supreme Court, including the Chief Justice, expressed serious concerns that doubts about guilt had not been resolved. And now, they never will be.
People in Georgia and throughout the United States are seriously disturbed by the thought of an innocent man being executed. Nothing can undermine public faith in a criminal justice system faster than an execution when there are still serious doubts about guilt. Your power to grant clemency exists to prevent such an irreversible error and preserve public faith in the state’s justice system.
My confidence in Georgia criminal justice has been shaken to the core by this case. I believe it is vital that you exercise your power of clemency in this case. I urge you to reconsider your decision, and to stop the execution of Troy Davis.

MARY'S COMMENTARY
This is a sad day for justice in America. This is a sad day for race relations in my beloved country. This is a sad day for death penalty opponents. This is a sad day for all the men and women on death row who hope that their DNA and other new evidence will be examined before they are killed by the State -- evidence that was unavailable when they were sentenced. This is a sad day for democracy.
If and when Mr. Davis is executed, please remain in your homes. Recognize that this may be done to undermine Mr. Obama's presidential campaign by creating racial tensions in this country. Remember that many people of all races have tried to help Mr. Davis. Do not be played. Go to the polls in November and vote your frustrations away.
It seems to me that a trial would have been the right thing to do FOR BOTH TROY DAVIS AND FOR OFFICER MacPHAIL!
WITHOUT A NEW TRIAL, THIS POLICE OFFICER'S FAMILY WILL NEVER KNOW WHO KILLED THEIR FAMILY MEMBER OR WHY.

Execution date has been set for October 27.
The Georgia Board of Pardons and Paroles denied clemency for Troy Anthony Davis shortly before 5 p.m. on Friday, September 12. They did so despite overwhelming doubts of Davis' guilt - and after stating last year that they would "not allow an execution to proceed in this State unless and until its members are convinced that there is no doubt as to the guilt of the accused." On September 23, The U.S. Supreme Court stayed Troy Davis' execution "pending the disposition of [his] petition for a writ of certiorari." On October 14, the Court decided not to accept his petition.

To all,
I want to thank all of you for your efforts and dedication to Human Rights and Human Kindness, in the past year I have experienced such emotion, joy, sadness and never ending faith. It is because of all of you that I am alive today.
As I look at my sister Martina I am marveled by the love she has for me and of course I worry about her and her health, but as she tells me she is the eldest and she will not back down from this fight to save my life and prove to the world that I am innocent of this terrible crime.
As I look at my mail from across the globe, from places I have never ever dreamed I would know about and people speaking languages and expressing cultures and religions I could only hope to one day see first hand. I am humbled by the emotion that fills my heart with overwhelming, overflowing Joy. I can't even explain the insurgence of emotion I feel when I try to express the strength I draw from you all, it compounds my faith and it shows me yet again that this is not a case about the death penalty, this is not a case about Troy Davis, this is a case about Justice and the Human Spirit to see Justice prevail.
I cannot answer all of your letters but I do read them all, I cannot see you all but I can imagine your faces, I cannot hear you speak but your letters take me to the far reaches of the world, I cannot touch you physically but I feel your warmth everyday I exist. So Thank you and remember I am in a place where execution can only destroy your physical form but because of my faith in God, my family and all of you I have been spiritually free for some time and no matter what happens in the days, weeks to come, this Movement to end the death penalty, to seek true justice, to expose a system that fails to protect the innocent must be accelerated.
There are so many more Troy Davis'. This fight to end the death penalty is not won or lost through me but through our strength to move forward and save every innocent person in captivity around the globe. We need to dismantle this Unjust system city by city, state by state and country by country.

- having regard to its previous resolutions on the abolition of the death penalty and the need for an immediate moratorium on executions in those countries where the death penalty is still imposed,
- having regard to UN General Assembly Resolution 62/149 of 18 December 2007 on the moratorium on the use of the death penalty in the world,
- having regard to the updated and revised version of the EU Guidelines on the Death Penalty, adopted by the Council on 16 June 2008,
A. having regard to the case of Troy Davis, sentenced to death by the Georgia State Court in 1991 for the murder of a policeman and scheduled to be executed at the end of July 2008,
B. whereas, according to Troy Davis' lawyers, there is abundant proof of his innocence, material evidence against him has never been produced and seven witnesses for the prosecution have retracted their testimony,
C. whereas on 4 August 2007 the Supreme Court of Georgia agreed to reconsider new elements casting doubt on Troy Davis' guilt,
D. whereas on 17 March 2008 the Supreme Court of Georgia denied Troy Davis a retrial, although the Chief Justice dissented,
E. whereas since 1975 more than 120 people have been released from death row in the United States, having been found innocent,
F. whereas in the United States the power of clemency in cases where a capital sentence has been imposed exists as a failsafe against irreversible errors that the courts are unable or unwilling to remedy,
G. whereas New Jersey is the first US State to have abolished capital punishment by legislation since the reintroduction of the death penalty in the United States in 1972, citing the inescapable risk of executing those wrongfully convicted,
1. Calls upon those countries where the death penalty is imposed to take the necessary steps towards its abolition;
2. Asks that Troy Davis' death sentence be commuted and, in view of the abundant evidence which might lead to such commutation, for the relevant courts to grant him a retrial;
3. Appeals urgently to the Georgia State Board of Pardons and Paroles to commute Troy Davis' death sentence;
4. Calls on the Presidency of the Council and the Delegation of the Commission to the United States to raise the issue as a matter of urgency with the US authorities;
5. Instructs its President to forward this resolution to the Council, the Commission, the Government of the United States, the Georgia State Board of Pardons and Paroles, and the Attorney General of Georgia.

duo, I like this story. It's good stuff.
Personally I am FOR the death penalty, but ONLY WHEN someone admits their guilt and/or there is ample DNA and/or video evidence that the person did it. Like that Richard Cooey I think his name is, who said he's too fat to execute. He's admitted to his crime and he thinks lethal injection will be cruel and unusual punishment because they might have a hard time finding a vein. BOO freakin HOO! We'll make your last meal cheese and whine.
Come here, let me put a 50 cent bullet in your brain, I promise you you will feel NOTHING.
On the other hand, when this many people have recanted their testimony against someone like Troy Davis, at least commute his sentence to life till the whole thing gets sorted out. But of course, we're dealing with a Bush stacked US Supreme court and with a President who pulled the switch on more prisoners in Texas than any other governor in history has done. It's to be expected that Troy won't get a fair shake.
Our court system is FUBAR and so is our prison system.

I wrote my opinion before, and here it is again: I believe the plan may be to kill Troy Davis, a likely innoncent black man, in order to create racial tension in my country and interfere with Senator Obama's election as President of the United States of America.
That is the only reason I can think of for our courts and our elected officials to deny this man a new trial, when he was convicted only on witness testimony, and now seven of the nine witnesses have recanted or been found to have entered conflicting testimony. The other two witnesses are the man who some say actually killed the policemen and another person.
I HOPE THAT IF AND WHEN MR. DAVIS IS EXECUTED, EVERYONE JUST STAY HOME AND PRAY FOR HIM AND HIS FAMILY, EAT A QUIET DINNER WITH YOUR OWN FAMILIES, AND DON'T EVEN GO OUTSIDE.
REMAIN CALM IF THEY KILL MR. DAVIS.
GET YOUR JUSTICE AT THE VOTING BOOTH IN NOVEMBER.

I am against the death penalty - for all humans, yes, especially for those who have no voice such as those who are still in their mother's womb. Life is sacred.
I am against the death penalty.
I think we need to be a voice for the voiceless. Whether they be the unborn, or those with severe mental problems or some other kind of impairment, they need for someone to be an advocate for them.
In some ways I see our society making advances in many ways, but when it comes to the death penalty, we are very backward. Man's inhumanity to Man is heartbreaking to me and I will pray for Troy and all of those who care about him. And I am grateful to all of those who were indeed a voice for him.
Please continue to be a voice for the voiceless.

I weep for the loss of American democracy. I cry out to the Father for our loss of freedom. I cry out against the fact that our Supreme Court would allow a likely innocent man to be EXECUTED without hearing his evidence, which arrived since his death sentence.
I weep and fast and cry out to God because it seems that justice is denied to people in our country unless they are wealthy and "connected," like the Johnnie Cochran Firm.
I weep for Troy Davis and his mother tonight. Troy, still your trembling hands. God yet sits on His throne. God yet is in charge. God is just. God loves justice. Watch and pray. The Hebrew children came to a Red Sea experience, but God parted the Red Sea.

I am so sorry Mary. I got another petition from a couple of groups to sign and keep trying. My God, there is enough evidence to at least give him another trial. How is that asking too much. They seem to take light the life of this man. I don't know him from Adam but I do believe there is something wrong in this case. Hell, the evidence is gone so what the hell are they thinking. No one is asking they just turn him loose, including him. He just want another trial. As you know, I am not happy with the judicial courts in our country right now. Until Obama gets in, we will continue to have blind polical justice. GITMO is proof that we as a country have lost our ethics and pride and understanding and compassion. I am still praying for you Mary.

Since our US Congress has never afforded poor prison inmates federal appeal legal counsel for their federal retrials,they have effectively closed the doors on these tens of thousands of innocent citizens ever being capable of possibly exonerating themselves to regain their freedom through being granted new retrials.
This same exact unjust situation was happening in our Southern States when poor and mostly uneducated Black Americans were being falsely imprisoned for endless decades without the needed educational skills to properly submit their own written federal trial appeals.
This devious and deceptive judicial process of making our poor and innocent prison inmates formulate and write their own federal appeal legal cases for possible retrials on their state criminal cases,is still in effect today even though everyone in our US judicial system knows that without proper legal representation, these tens of thousands of innocent prison inmates will be denied their rightful opportunities of ever being granted new trials from our federal appeal judges!!
Sadly, the true US *legal* Federal Appeal situation that occurs when any of our uneducated American prison inmates are forced to attempt to submit their own written Federal Appeals (from our prisons nationwide) without the assistance of proper legal counsel, is that they all are in reality being denied their legitimate rights for Habeas Corpus with our US FEDERAL COURTS and will win any future Supreme Court Case concerning this injustice!
For our judicial system and our US Congressional Leaders Of The Free World to continue to pretend that this is a real and fair opportunity for our American Middle Class and Working Poor Citizens, only delays the very needed future change of Federal Financing of all these Federal appeals becoming a normal formula of Our American judicial system.

US Supreme Court denies justice for Troy Davis & lifts stay of execution!
What: Demonstration for Troy Davis
When: Thursday, October 23rd at 5.30 PM
Where: 33rd Street and 8th Avenue - SE corner (NYC)
Who: Campaign to End the Death Penalty, Amnesty International, American Civil Liberties Union.
Why: October 14th, the US Supreme Court denied Georgia death row prisoner Troy Davis' request for a new trial. The decision was a cruel answer to Troy and his family who were hoping the Court would review the facts and circumstances surrounding his unjust conviction. Troy was convicted without physical evidence -- instead, the case
against him relied on witness testimony. However, since his conviction 7 of the 9 witnesses have recanted their testimony at trial.
Troy's case has become an important battleground for all those who are concerned about the unfairness of a legal system that routinely sends the poor and minorities to prison without due process. Concerns about Troy's case have prompted a wide range of individuals from across the world to call for a halt to his execution. From former President Jimmy Carter to Rev. Desmond Tutu, people concerned with justice have been organizing on Troy's behalf.
