The Gang Rape Case of  a Poor SC/ ST  Girl in Dehradun (Uttarakhund)<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" />

The Girl (Name: Ms. Sulekha ) was Gang Raped by Five Men on 19th April 2008 who are considered to be most powerful and influential people since they are allegedly from the Ruling party of Uttarakhund and it is also understood they hold some important portfolio in the Government or in the Ruling Party.

The Girl was lured for a better State government job by one of her close related cousin handicapped Brother (Name: Ashok) who has acted as a proven Pimp and an accomplice in this case, on this pretext the accused Ashok told the victim girl to accompany a so called Government Official in his Car to a Hotel in Dehradun for her job Interview, (Hotel Name :- Rajpur Resort), and he further assured the victim girl that there were  more girls waiting in the Hotel to take up the job Interview.

Since the Victim was assured by her own cousin brother, she had no doubt, and she went along with this so called Government official to the Hotel in Rajpur Road-Dehradun.

On her arrival to the hotel she was given a glass of water, and immediately the victim fell partial unconscious, with this effect she was dragged to the hotel room where she was Gang Raped and further the victim was Photographed & Video graphed to be blackmailed whenever required by the criminals.

After the gruesome Rape, the victim’s cousin brother took the girl to another location and did unnatural and abnormal sexual assault and molested the girl by blackmailing her by her photographs taken: soon after this he dropped the Girl in her house.

Due to the social Fear and unawareness of her Human Rights; she had kept the entire suffering and the heinous crime to her own self for around Two Months.

Mean while after the Rape, she had fallen ill and was unable to move out of the house for some time. Further she started to avoid her cousin brother, since her cousin brother (Mr. Ashok) was constantly calling her to be raped again by blackmailing.

When her cousin brother failed on all accounts to lure the victim out of her house to be raped again, he then convinced the girl to do some training course, by doing so, her cousin brother would get the opportunity to meet the victim out of her own house and force her to be raped again.  

With this pretext the girl’s cousin brother along with the Victim girl came to Samadhan and took an admission to a Seven days NGO Management course with a mal intention to exploit Samadhan’s facilities. It was here in Samadhan during the training course where she was taught and empowered with the Laws of Human Rights and Indian constitutional Rights along with other NGO Management subjects. Within the course of her training the victim was enlightened towards her Human Rights, and immediately thereafter she decided to inform her suffering of Gang Rape to Samadhan and the Police.

Samadhan had given the specific counseling- as per the ruling of Supreme Court of <?xml:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" />India - to the victim and made aware of her social and legal rights. The victim then decided to lodge a FIR for this gang Rape case at her own will. Then on her request she was escorted by our volunteers to the Police Thana to lodge the FIR.  

Initially the victim and Samadhan’s volunteer had faced difficulty in lodging the FIR. However as soon as the victim and Samadhan’s volunteer approached the office of DGP Dehradun, the officials took a serious listening and were referred immediately to the right Police officials.

Finally on 19th June 2008 the FIR under section 376 IPC was lodged at Rajpur Road Thana, here the Police officials took immediate action toward the FIR. With this effect the victim was sent to immediate Medical Examination at the Government Hospital (Name: Doon Hospital). And thereafter the first accomplice was nabbed / arrested by the police on the same day.

The next day on 20th June 2008 the victim recorded her Statement under Section 164 of Cr.P.C. It’s important to take a note that some Press and Political personnel also a group of Lawyers manhandled and stopped the victim and Samadhan’s volunteer to record the statement on the day of recording the statement under section 164 of Cr. P.C. this incident took place in front of the police personnel.

On 21st June 2008 the second culprit and the so called “Government Official” was nabbed / arrested, and further was identified by the Victim as one of the Rapist. It was also learnt from the police on the same day that the culprit had accepted to the Rape crime. Further it was learnt that the Identified person’s name was Mr. Pramood Gupta, A BJP member, who is former head of District Cooperative Bank and a special nominated member of the BJP State working committee.

Immediately after this action there were various types of pressures mounted on the victim and Samadhan till date by various state machinery and political parties for their vested political interests.

Still Not Arrested – Criminals at large:

It is surprising to know that it’s been past over TEN Days and the other Three Rape culprits (Rapist) are roaming freely in the town, instead of arresting these three culprits who are at large, the Local Administration started harassing and mounted pressure on Samadhan by conducting investigation and enquires by the Local Intelligence Unit (LIU). Samadhan is being treated as if they are the Criminals. This is done to break the Morale of Samadhan, who is a dedicated Human Rights organization in the State.

Other Action Taken:

Due to the various Threats and Pressure mounted on Samadhan and the Victim, on 21st June 2008 Samadhan had informed about the detail case to various Government Agencies and Organization by email such as the…. 1) National Human Right Commission - NHRC 2) National Commission for Women - NCW 2) National Commission for Scheduled Castes – NCSC. To keep them informed about Samadhan’s well found fears of getting erased by those powerful people and state machinery as well.

Administration Response Failure:

The irony in this state is, despite of so much News in the Electronic and Print media regarding this High Profile Gang Rape, the State Scheduled Cast / Backward commission and the State Commission for Women failed to meet or respond to the cry of the victim till date.

Instead they both kept on giving irresponsible statements against Samadhan to cause further harm to victim’s welfare, thus making the criminals further more empowered.

All these dirty politics is still going on nonstop till date. (Please refer to the Local Newspapers).  These state level organizations are demanding to the Local Administration to separate the victim from Samadhan by using force and handing over to Nari Niketan without the victim’s consent.

It is important to take a Note here, that some of the people who are in these organizations; who are speaking such ill things or against the Rape case, what are their interests? Or do these people have any type of relationship with the criminals? This is a matter of serious Investigation and impartial serious enquires should be carried out by CBI against these irresponsible elements. This will help the police to nab the other three Rapists who are at large and bring justice to the Victim.

Initial Interim Relief Given - (As per SC / ST Act):

After various request from Samadhan and pressure from all quarters such as the Media, NCSC, etc. on 25th June 2008 in the late evening (around 9:30pm) a small amount of cheque of Rs. 25,000/- as the Interim Relief (As per SC/SC Act)was issued from the office of Social Welfare Department and was delivered by the ADM along with the officials of social welfare dept to the victim at Samadhan office Dehradun, right on the eve of Hon. Sh. Buta Singh visit to Samadhan – Dehradun.

Hon. Sh. Buta Singh's Visit to Samadhan – Dehradun:

After passing more than Six Days and the failure of the State ST / SC commission to visit or to respond to the cry of the victim, on 26th June 2008, Hon. Sh. Buta Singh (Chairman NCSC), responded to our email and took the self initiative and came to Samadhan – Dehradun, along with his Team to extend his solidarity to the victim and support to Samadhan, and took the complete account of the present situation.

What support does the Victim need Now?

With current mounted negative pressure both on the Victim and Samadhan, such pressure is hindering the process of investigation / identification and arrest of the three Rapist who are absconding presently, with this effect a constant fear of physical security is being established and a continuous mental torture is being subjected to the Victim and Samadhan.

1. The Victim’s request to the Local and Central Authorities is to make serious investigations on people who are making any statements which is against the Rape case, such as a) Sending the victim to Nari Niketan b) Negative Pressurizing  Samadhan not to provide any Legal help & support to the victim c) Defaming Samadhan d) Those alleging the girl’s case as a false story, …etc. this clearly & logically indicates that these people would definitely have directly or indirectly some connections with the Rapist, this is a matter of serious questioning and investigation, and to find why these people are trying to protect the Rapist  while the case is subjudiced and Police investigations are on.

2. Need of continuous security to both the Victim and Samadhan till the Three Rapist is Identified and Arrested.

 3. All Authorities, Media and responsible People should STOP their constant effort to do the character Assassination of Adv. Renu D. Singh (President of Samadhan) and defamation of Samadhan. This is leading to destruction of trust and Faith of common people towards the Law of the Land and the working of good NGOs, this is also deviating and diverting from the process of investigation and arrest of the criminals.

4. The Victim and Samadhan are not safe till the Culprits (Rapist) are not nabbed. Police should not play any type of political role to jeopardize the Human Rights situation in the State. Common Public would get provoked which may lead to civil turmoil and instability.

5. Responsible commissions and authorities should be utmost sensitive in handling this rape case, and provide immediate Relief support, financially or otherwise to the victim.
