The Washington Times is reporting that on December 5, 2008, the United States Supreme Court will decide whether to hear a case brought by Leo Donofrio that alleges that although President Elect Obama was born in Hawaii, he is actually a British citizen, due to the nationality of Mr. Obama's father, Barack Hussein Obama Sr.

At the time of the President Elect's birth, in the year 1961, his father's homeland, Kenya * (Please see below.), remained under British colonial rule, not gaining so called independence from Great Britain until 1963.

The article states that if the court decides to hear the case:

It would mark the first time in American history the questionable citizenship of a winning presidential candidate would go before the Supreme Court.  

The claim that President Elect Barack Obama, former candidate and senator, was ineligible to serve as President of the United States, due to circumstances surrounding his birth, has been circulating in newspapers, magazines, on television and the internet for almost two years.

There are more than a dozen lawsuits, in at least six states, making their way through those states' court systems.

Our Country (Still The USA) is founded on the US Consitution. The laws layed down apply to all which, includes even Barak Obama. He should be the first person to make known all information to document his citizenship with true and verified information,to this day Obama has not done so, for the US Supreme court not to acknowledge the facts is an outright failure of our entire Constitution and, the beginning of the end . As, was pointed out some years ago, a famious Quote from history:

It appears that, despite all of the information and documents provided regarding the birth of President Elect Obama, nothing short of film of his emergence from the womb, complete with locale points to verify where he and his mother are, will be sufficient.

Um... millions of Mexicans sneak over the border each year and give birth to children who are instantly American citizens. If you are BORN in the United States, you are an American citizen. <--period

I'm mindful that I'm stating the obvious, but it seems some people can't seem to realize that Hawaii is one of the 50 states.  President-elect Barack Obama is an American citizen born in Hawaii.  The issue about the alleged "dual citizenship" is unfounded because according to Kenyan law, Mr. Obama can not be its citizen even if Kenyan people may want to claim him, or some fringe American groups might claim that he is not American. 

Justice Clarence Thomas is an arch-conservative who has his own agenda by agreeing to review this absurd case about Mr. Obama's citizenship.  It just shows that conspiracy theories still resonate with a subset group of Americans.  

In the past, the legitimacy of presidents from Thomas Jefferson to Abraham Lincoln has been questioned, though none about their citizenship status.

The Electoral College was created by the American Founders to put one extra check on the popular vote, and it is unlikely that the Dec.15 certification process would or could overturn the final Electoral College counts that clearly shows Barack Obama is the President-elect.

I cannot WAIT for this issue to be resolved.

My only concern is why Obama didn't just clear it up at the beginning of all the hoopla.

But, really, the CIA or the FBI, it seems would have known from the beginning if he wasn't born in the USA.

It doesn't make ANY difference where his parents were born...if he was born on US soil legally, he is a citizen.

The Supreme Court must need some publicity to take on this case.  I agree with others that it should take the highest court to look at a birth certificate.

My thanks to Everyone for their comments and recommendations.

It seems beyond the utmost of silly to believe that had this issue been a true issue, it would have ended then Senator Barack Obama's run almost two years ago.

All embracing this method of attack seem to disregard that all of this must have been settled during the preliminary vetting process for the run for the office of President of the United States.

Alan Keyes' lawsuit is yet another example of the Conservative Right Wing's efforts to set in motion conditions meant to attempt to reverse an election outcome with which they were displeased.

How can he be a US Senator if he is not an American citizen, they will failed if they challenge this in court. The people has voted and spoken for him. Barack Obama will be the President of the USA come January 2009 period.

Amy, in all honesty, I am convinced had this been a truly legitimate issue, he would not have been allowed to enter the presidential race more than two years ago.

If those in opposition are fighting this so hard now, it has to be a safe bet that they all were gathering all they could, making the same arguments for lo all of these almost two years.

These attempts can be perceived as an attempt to overturn the election, with most who have gathered behind these tactics, representing individuals in disagreement with the selection of President Elect Barack Obama by the majority of Americans AND the Electoral College.

Attempts to overturn the election are what should be of most concern to American citizens.

Sealed Documents in Kenya?

Here are some good valid questions that the Media needs to be asking.

Why would Mr Obama spend almost 1 million dollars fighting to NOT show a 12 dollar document that any US Citizen can easily access? 

The FBI / CIA / Secret Service does not do background checks on elected officials.  It is reported that Mr Obama's first US Passport was issued when he became a Senator (no background check for elected officials), so how did Mr Obama when he was college aged visit the countries of Pakistan, India and Indonesia?  This was before he EVER had a US Passport, which leads to the next obvious question.  Which Passport did he use to go to these countries, that HE HIMSELF said he went to?  Did he use his Indonesian Passport?  A UK Passport?  A Kenyan Passport?  How can there be SEALED BIRTH DOCUMENTS in Kenya if Mr Obama is said to be born in Hawaii?  Why does everyone believe that the 'CertifiCATION of Birth' on Mr Obama's website holds the same LEGAL WEIGHT as a 'CertifiCATE of Birth'?  If it is said the Mr Obama is very intelligent, then why hasn't Mr Obama released any of his college transcripts? 

Time and time again, Mr Obama has not released any documents that have been asked on him.  Mr Obama in his earlier Senate races has sued to have his opponants SEALED divorce records opened by the court to have his opponants disqualified. 

Mr Obama, a Constitutional Lawyer, needs to be held to the letter of the law, Constitutional Law.  Maybe this is why Mr Obama turned down the Clerk of Courts position with the Supreme Court when he graduated Harvard Law.

It got Boy George Bush the war he wanted.  Many ignorant knotheads still believe Iraq had something to do with the attacks of 9 September 2001.  Many of 28%'ers actually still believe there were weapons of mass destruction found.  

Now we have this ridiculous flood of ridiculous claims (with no sources) chipping away and hoping to find gold.

This is such a simple solution.  All Obama has to do is get an actual copy of his birth certificate and show it.  He has not yet done this.  All he continues to say when asked for it is "Its not necessary"  What does he have to hide?  Prove everyone wrong and just show the documents, make everyone who is accusing you of not being eligible for President look like idiots.  Its so very very simple yet he won't do it.  Why?

Whomever was required to see the documentation of his birth has seen it.

Anyone who has had to prove their identity in this country whenever one needs to do anything, get a driver's license, etc., is aware that nothing less than satisfying the bureaucracy will do. Would anything less do for anyone seeking the presidency?   

Indeed, "It's not necessary", if in order to appease any and all idiots, he is somehow expected to produce, on demand, whatever is asked of him by any and everyone.

Do only black presidential candidates have to publicly display every part of their claim to citizenship?  Or is it just ones with funny-sounding that make xenophobes get all scared?

Where is McCain's birth certificate?  McCain was not born on U.S. soil and was born before the U.S. military exception to those who were.  If either was an issue, we would have a wash.

However, McCain is white, old and has convinced a army of followers that he is a redneck, rather than ultra-rich elitist he really is.

I can see the felons, drugheads and sex perverts on right-wing WAKO radio have their jobs secure.  

I wonder where Obama keeps the missing 18 minutes of the Watergate tapes?

The question about whether Obama is a bona fide US citizen is not because he was born in Hawaii, the question is whether he was born in Kenya and then his mother went to Hawaii to register his birth there.  According to Obama's paternal grandmother she was there at his birth in Kenya and stated that Obama's mother was not able to leave before giving birth because the airlines would not let her board the plane because she was almost due to give birth. 

Two hospitals in Honolulu claim that Obama was born in their hospital, which is it?  So the question is not if he is a citizen; to be president you have to be born in the US, or to parents (both parents) being US citizens if you were born outside the country.  Obama's father was not a US citizen, so Obama could not qualify to be president if he in fact was born in Kenya.  That's the question!

To reply to Alvin Yong, no you do not have the same qualifications to be a senator.  You just have to be a US citizen for nine years to become a senator.  Many US Senators were born and were citizens of other countries before becoming a US citizen.

Ok, I went to http://itsallmaya.com/.  Once again, I get "he said - she said" sourcing with no sources or proof.  I find it interesting that so many people in we can't have one of them as president seem to feel the Supreme Court fears for its life and the security of the country if it crosses Obama supporters, especially since it's most been right-wingers shooting at our judiciary (Texas Sen. John Cornyn said violence against judges is "understandable", by the way).

When the court rules that we have take on board a president we didn't elect, "activist" judges are okay.

When people try to hold to the government accountable to anything in the Constitution besides the Second Amendment, those peoples are enemies of the state (words used in the totalitarian sense from which they arose).  However, also rising from the ashes of despotism is the "big lie" that had been with us since the Reagan Era.  If you take a whacked out idea and push it enough, people will begin to believe trees are causing global warming.

Yes, I do know what a parody is.  In good examples, they are funny.  While yours may entertain well in a redneck bar, I personally am getting tired of the "humor" that if we'uns don't all shuffle along and do things just the ways Mr. Obama say that "those people" are going to riot and start killing judges.

I think my initial reaction stands.
