Martha Coakley has designed a task force for public corruption and hopefully, she will read this article and start to understand what is going on in one court at least in her direct supervisory area of Massachusetts, Plymouth District Court, Brockton Division. Having been a former District Attorney and prosecutor, it would appear that she would have an interest in knowing that files are being placed into endless piles of court cases in the District Court offices and the (unlicensed???) personnel that seek out those piles of files to bring into the courtroom are none the wiser. One could just sneak a few in someone's pile and it would automatically become a Commonwealth case. No questions asked. The same goes for removing files. If the file is missing so is the punishment and rightly so. Courts in this country need some revamping. It appears that the laws have been updated occasionally since Thomas Jefferson and his buddies signed the Declaration of Independence and really started the era of justice and liberty for all. But what has not ever been taken into consideration are the willful actions of court personnel who lessen the burden of their responsibilities and sweep records under the rugs. Undercover, I watched during an entire day of one astute judge, fifteen assistant DA's and one very special clerk deliberate over causes, dates and circumstances that would appear normal in an everyday sense to the legal eyes but on this day displayed numerous scenarios of incompetence and neglect. During the entire day there were no court reporters tracing what was being talked about during what is known as pre-trial hearings and administrative adjudications. A cocaine dealer was released by the judge because the probation officer could not recommend a disposition to the court and so the prisoner was not charged after he tested positive for cocaine which violated his probation. But based on the fact that his outfit resembled a fancy bus driver's or an off duty security officer he went home. Two dark and handsome men with rostaferian hairdos who were charged with heinous intentions were also allowed to leave the courtroom unscathed although, one or two attorney's refused to show up in court at all that day. It's a scary situation to see that the District Attorney Timothy Cruz has allowed anyone and their brother to enter into his District courthouse as long as they have the same color file folders. In other words, it appears that in some way the DA Cruz is very organized. If an unnamed assistant to the DA should show up at the courthouse carrying with he or she similar items that would normally be produced within the offices of the District Attorney, they are blessed by the court and allowed to proceed without repudiation or concern. And what lawyers or "Assistant DA's" use identification in court and most of the judges float from other court jurisdictions. So not in Brockton, Massachusetts anywhere is the word continuity understood. If the public wonders why some offenders are placed in jail for 25 years and then released after new DNA evidence shows up, you can be assured that those are some reasons. One unnamed long-haired assistant district attorney allowed a felon in custody to be released because they told the judge, his file is missing. We don't have a file on him..... So where is Tim Cruz while all this is going on? He is never seen anywhere near the courthouse during the week for the last few years that I have been sneaking around. If he is somewhere in some office, he has no idea what the names of his staff are and who is present for what judges and what cases are to be heard on any given day in the District Court of Brockton, MA - Plymouth County. And let s not even get into the fact that if you are brought downstairs in either male or female holding area - you may never leave....There were 20 personal items bags in a holding area with an entire area of empty cells. What happens to the vagrants, indigents and not-so-lucky persons who are arrested by these not-so-educated police who use organization to create Commonwealth cases? And are most of them missing college students?   Maybe Martha Coakley can find out...because Tim Cruz couldn't tell you where the courtrooms are located nor would Governor Patrick Deval give a hoot whose who and who's whose.
