Why Is Earl Mann Getting Out of Prison April 2009?

In an announcement in Akron, Ohio the town where Clarence Elkins was tried in a 1998 murder/rape case.  Ohio Innocence Project representatives and defense counsel for Elkins revealed that DNA evidence obtained from another man, Earl Mann, was a match with DNA found on the body of the murder victim and her 6-year-old granddaughter.  

No physical evidence, DNA or otherwise, has ever linked Elkins to the crime scene in Barberton, Ohio, where 58-year-old Judith Johnson was raped and murdered and her granddaughter was also beaten unconscious and raped.

Elkins was the son-in-law of Johnson and is an uncle of the younger victim.   A 10-year nightmare for Judith Johnson's family ended Monday when Earl Mann admitted he killed her and was sentenced to 55 years to life in prison.

In April 2009, Earl Mann a convicted "child molester" is scheduled to walk out of prison. Summit County prosecutors failed to include "with force" in the child rape indictment against Mann back in November 2001. That, as well as other problems with the case, led to a seven-year plea deal with the prisoner who otherwise could have faced up to 114 years in prison.

To make matters worse, Summit County's evidence vaults have been burglarized. Chief Assistant Criminal Prosecutor Mary Ann Kovach dismisses concerns that this will hurt the case against Mann. "The Earl Mann evidence or Elkins evidence is all in my office," she says. "My office is locked every night by me."

Kovach will not comment on the information Cindy Elkins passed on to Brandon and Clarence Jr. the night before their father was released, that Mann gave a "partial confession" about his possible involvement in Judy Johnson's murder.

 Melinda has been tireless in trying to bring justice to her mother Judith Johnson, to her niece, and to her husband, Clarence Elkins. She has led the fight from Day One. She was able to do something that the police and prosecutors were not able to do "solve this crime".

It was known she would not stop until she accomplished this. Clarence has been an inspiration with how he has handled this bizarre turn of events in his life with grace and dignity. Everyone is overjoyed for both Melinda and Clarence that his day has come.

I have a serious question though is it that this predator is sentenced to 55 years to life in prison or is he getting out in April 2009?

Travesty of justice as usual. Lazy police and investigators. Convict an innocent man to make their job easy. Refuse to look at the case with undeniable new evidence. Innocent man's wife has to do all the work while an innocent man suffers in prison for 7 years. Then the prosecution bungles a conviction on the guilty.

Earl Mann is a predator and will commit murder or rape again. He should remain in jail, especially after all the work Melinda and Clarence have managed to find as solid proof against him.  I will never understand how Earl Mann stood by and did nothing while seeing another man go to jail for his crime. My praise to Melinda for clearing her husband Clarence, and the courage it has taken from both of them to find solid proof and mother's real killer and niece's rapist. Clarence has suffered greatly and following freedom, I cannot comprehend why after years of work to free Clarence, that he and his wife are today divorced. It also shows you that witnesses such as niece are not viable proof as Clarence went to jail for absolutely nothing. Melinda: Clarence loves you and will forever be thankful for all you have done for him; you too should be together for life.  As for Earl Mann, may you rot in hell.

Amazing how Clarence Elkins was sentenced to life (after his wrongful conviction) for the same crime this guy gets let out of prison in a few years for a bargain. We will all watch helplessly as the system drops the ball first chance they get. This man will commit rape and murder as soon as he is allowed out. Mark my words.

If this man does not receive a lengthy sentence the family of Judy Johnston should sue the state for failing to protect their niece, their family and any future victims should also consider suing the state. This is a ridiculous travesty of justice that an innocent man may serve more time than the guilty one. This social parasite should be left to rot in jail where he can no longer hurt others.

This is just another case of an over zealous Police Force not doing it's job.  The problem with most of these cases is that the local authority (Chief or Sheriff) is an elected member and to mantain he is the right person for the job they will take the easy road to an arest and conviction.  I hope that Clarence Elkins and his family sue the state as his life will never be the same and people will always look at him differently.

I just finished watching the Forensic Files episode on this case and it stated that he was sentenced an additional 55 years for his involvement in the rapes and murder of Judith Johnson. The thing that shocked me was that when her granchild regained consciousness after the attack she went to the neighbor for help and the lady that answered the door was Mann's commonlaw wife who made the 6 yr old sit outside for 45 minutes before giving her a ride home. If anything, the woman sheould be convicted as well.
