Over the past two years, American history in the United States has outdone itself in regards to raising awareness for blacks and women. Catapulting an African-American man to the highest position in the country and choosing one more female to sit on the
Supreme Court has caused quite a bit of controversy.
At first glance, one may suppose that these two feats were extraordinary. Then, when taking a second look at the situation, we can realize that neither historical event’s in our public government will help to create changes in our government because we are still struggling to perfect a system which depends on the basic
“Bill of Rights” written in the late 1700’s and on a
Constitution which is used in name only.
This legal system promised to guide and control American citizens living in the US and intended to keep decisions sensible and realistic while assuring that the mainstream individual stood conformed. What difference does it make to hire a woman judge in a court system when there are so many mistakes made by different state governments that cause our court cases and verdicts to end up as a farce? What is a woman going to do that a man can't do?
In the USA there is a lack of civil rights for both male and female individuals. Regardless of the fact that there is a civil rights movement cradled by the President of the US,
Barack Hussein Obama but those civil rights are rights for those citizens who have a darker color than everyone else. Civil rights do not ever come into play when it means the rights of a single, white woman. Nor does it matter for the less fortunate or under privileged people living in a lower income and struggling middle class structure.
With the decisions that are being discussed in the Supreme Court lately, the impact or results really don’t make our world a better place to live in. Millions of dollars and thousands of hours are spent in courts around the country trying to sort out criminal and civil acts allegedly committed by the accused and most often the cases are tried and retried until they reach the Supreme Court without the personnel ever auditing the procedures and steps that make up a genuine court case guided by the Constitutional rights and the talked about inalienable rights.
It is a Supreme court that is uncommon to the general public and where
Elena Kagan has just been sworn in to accept her new role as a member of the justice system. However, what's so great about it? Because there, in the Supreme Court, the public never actually have a chance to listen to or to comprehend what new opinions are given out by the justices. These opinions are eventually thrown into a pile of other textbook jargon but none of the lawyers practicing in the state courts take notice of them, or even seem to remember the opinions during efforts to maintain the rights of the accused or lack, thereof.
The current legal state of affairs in the USA has been overshadowed by many disasters which are saturating our country lately. Problems which surround the average citizen and their lifestyle and right to live under the umbrella of the Constitution protected by the Bill of Rights are not priority at this time.
Perhaps, it is due to the fact that our president has several other agendas. Nominating and hiring another woman justice will not help to prioritize any lack of
Civil Rights that We, as American citizens experience but it will help to keep historical memories marking the pages of our history books until we stop manufacturing them, of course.
Kagan was confirmed by the Senate 63-37 on Thursday. Republicans complained about her lack of judicial experience and liberal leanings. She won't be formally installed until the new court term begins on Oct. 1, but she can assume the duties of a justice, including reviewing cases and emergency appeals.
